The owner of this website sets out the following privacy policy that shall govern the processing of personal data.

2. Why do we collect and use your personal data?

Personal data voluntarily provided by the user may be processed by LBS for the following purposes: 

• Management and attention to all requests for information, consultation, complaint or any other type of request made through any channel established by LBS.
• Where appropriate, management of the commercial relationship.
• For compliance with legal obligations.
• When the user gives express consent to do so, sending commercial and promotional communications that may be of interest by LBS.

You guarantee the authenticity of all personal data provided and assume the corresponding liability deriving from the lack of its veracity or accuracy, including the damage caused to LBS or third parties for these reasons.

3. What is the legal basis for the data processing?

The legal basis for the processing of personal data is the express consent given by the user when registering on the platform, by clicking the “send” button on the data collection form or by sending the data by any other means.

When the purpose is commercial management, the legal basis for the processing of data will be the execution of the contract.

When the purpose is the fulfillment of legal obligations, the legal basis for the processing of data will be the fulfillment of legal obligations.

In the case of sending commercial communications, the legal basis for the processing is the express consent that you provide by clicking on the button “I authorize to receive commercial communications”.

The User may withdraw his/her consent at any time, without affecting in any case the lawfulness of the processing based on the consent prior to its withdrawal.

4. Period for which your personal data will be stored

The personal data provided will be kept for the entire duration of the use of the services offered by the site, and as long as the interested party does not oppose to its processing when the services are not used, or the user does not state otherwise.

Regardless of the above, the personal data will be kept duly blocked for the duration of the legal obligations that may arise from the processing.

5. Who do we communicate your personal information to?

The personal data provided may be communicated or shared for the proper functioning of the provision of services offered by LBS. Specifically, the third parties that will have access to your data will be:

• The subsidiaries of LBS CAPITAL DEVELOPMENT, S.L.
• The BMBI real estate IT platform.
• Any other suppliers that LBS considers necessary to adequately carry out the provision of housing development services, always complying with the requirements established by current legislation on data protection.

6. Do we make international transfers of your personal data?

International data transfers may be made to a third country or international organization outside the European Economic Area as long as it ensures an adequate level of data protection.

LBS may make these transfers without the need for any specific authorization, under the provisions of Article 45 of the General Data Protection Regulation.

Based on this legal provision LBS may transfer your personal data to Israel, the country where the BMBI platform is located, a territory declared as having an adequate level of protection by the European Commission by Commission Decision of 31 January 2011 in accordance with Directive 95/46/EC of the European Parliament and of the Council on the adequate protection of personal data by the State of Israel with regard to automatic processing of personal data.

7. What rights do you have regarding the processing of your data?

As the owner of the personal data, the User may exercise, with the exceptions and limits established in the applicable data protection regulations, the following rights:

• Right to withdraw the consent given for the processing of their personal data at any time.
• Right of access: allows the data subject to obtain information on whether we are processing personal data concerning him/her and, if so, to obtain a copy of such data.
• Right of rectification: allows you to correct errors and amend any data we hold about you that proves to be inaccurate or incomplete.
• Right of erasure: allows the data to be deleted and no longer processed by LBS, unless there is a legal obligation to keep it and/or other legitimate reasons for its processing do not prevail.
• Right to limitation of processing: under the conditions established by law, allows the processing of data to be suspended, in such a way as to prevent processing by LBS, retaining them only for the exercise or defense of claims.
• Right not to be subject to automated individual decisions, including profiling.
• Right to object: in certain circumstances and for reasons related to their particular situation, data subjects may object to the processing of their data. LBS will stop processing the data, except for compelling legitimate reasons, or for the exercise or defense of possible claims.
• Right to data portability: allows the data subject to receive the personal data provided to us, in order to transmit them to another data controller, in a structured, commonly used and machine-readable format.

To do so, the user must write to the Data Controller, enclosing a photocopy of their national identity document and indicating the right they are exercising. In any case, you are informed of your right to file a complaint before the Spanish Data Protection Agency (www.aepd.es), when you consider that you have not obtained satisfaction from the data controller in the exercise of your rights or you consider that the processing does not comply with the regulations in force.

Likewise, you are expressly informed of the possibility to revoke at any time the consent given to receive commercial communications. To do so, you can write to the email address info@lbs.eu.com indicating in the subject “Unsubscribe from commercial communications” and your request will be answered.
